Terms and conditions of the Mac’s Too Easy Promotion


Promotional period and eligibility


The promoter of this promotion is Wholesale Distributors Limited (t/a FreshChoice supermarkets), 29 Byron Street, Sydenham, Christchurch 8023 (“Promoter”).


This Promotion runs in New Zealand from 04/11/24  until 15/12/24 (“Promotional Period”).


This promotion is open to New Zealand residents aged 18 years or older who shop online at  https://www.freshchoice.co.nz/ (the “Website”). Employees of the Promoter are not excluded from participating in this promotion.

Prizes

There is:


40 (Forty) x $100 Fresh Choice vouchers  to be won, nationwide.

 


The Prizes will only be delivered by post in New Zealand and each winner should allow up to 14 days from the date of the prize draw for delivery of their Prize.


Method of entry


During the Promotional Period, customers are able to enter the promotion by purchasing one or more Mac’s Too Easy products in one transaction in store during the Promotional Period and will receive entry details on the printed receipt. This will direct customers to the FreshChoice website where they can submit entry details.

Entry is limited to one entry per transaction. The entry date is the order delivery date, which must be during the Promotional Period.


The Prizes are not transferable, redeemable and may not be exchanged for cash, and cannot be used in conjunction with any other discounts or offers.

The Promoter reserves the right, in its discretion, to remove products or to introduce further products from the Qualifying Purchase during the Promotional Period.

Winners


Prize draw - 40 (Forty) prize winner/s will be determined by a random electronic draw from all valid entries received in the promotion on 17/12/24. The draw will be conducted by the Promoter.


The Promoter will contact the winners. The winners will be notified by telephone and/or email using the details listed on the winners’ FreshChoice online account.  It is up to customers to ensure that their relevant details on their FreshChoice online account are correct.  Details can be updated by emailing the FreshChoice Customer Care team at [customerinfo@freshchoice.co.nz].


In the event a winner cannot be contacted (that is, cannot be reached by telephone and/or does not respond to email) within 48 hours of each prize draw, the Promoter will send the winner a letter giving a further 7 days from the date of the letter to get in touch with the Promoter.  If there is no response to the letter, a winner will be redrawn on the same terms as the original draw. This process will continue until a winner is able to be contacted.

 


Exclusions and liability
The Promoter will not be responsible for any late, lost or misdirected entries, including but not limited to, entries not received due to technical problems.
 
The Promoter and its related companies, employees and agencies shall not be liable for any loss, damage or personal injury suffered by any person arising directly or indirectly out of or in connection with entering this promotion or claiming/winning any prize, or availing themselves of any prize, except as required by law.


The Promoter is not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction associated with the promotion.

Use of personal information

 All entries remain the property of the Promoter.  All personal information will be collected and stored by the Promoter in accordance with the Privacy Act 2020 and the Promoter’s privacy policy which can be viewed at https://www.freshchoice.co.nz/privacy-policy/.


The Promoter may use entrants’ personal information from entries to conduct the promotion.  The Promoter may use winners’ personal information for such publicity purposes as reasonably determined by the Promoter.


By entering this promotion, entrants consent to the use of their information as described above.

General terms and conditions
The promotion is conducted by the Promoter in accordance with these terms and conditions. To the extent that any matter relating to the promotion is not covered by these terms and conditions, the Promoter reserves the right in its sole discretion to conduct the promotion as it sees fit, subject to any legal requirements or vary the terms and conditions as it deems reasonably necessary. 

By entering into this promotion, the entrant agrees to be bound by these terms and conditions. The Promoter reserves the right to deem any entry void should an entrant fail to comply with any of these terms and conditions.


The Promoter reserves the right to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions. The Promoter’s decision is final. 

The Promoter reserves the right to extend, suspend, modify, amend, vary, terminate or withdraw the promotion at any time in its sole discretion.

The Promoter will not be responsible for any delay or failure to deliver, or damage caused to any Prize during transit.

All decisions of the Promoter are final and no discussions or correspondence will be entered into. 

Failure by the Promoter to enforce any of their rights under these terms and conditions at any stage does not constitute a waiver of those rights.

By participating in this promotion, entrants grant a perpetual worldwide non-exclusive royalty-free licence to the Promoter to use and sub-licence the use of any copyright (including future copyright) in and to any entry submitted. To the extent that an entrant has any moral rights in their entry, the entrant hereby provides consent for the Promoter and its licensees to do any act or omission that would otherwise infringe that entrant’s moral rights.  Each entrant warrants to the Promoter that his or her entry does not infringe the intellectual property rights of any person.

These terms and conditions are governed by the laws of New Zealand.
