Promotion

Entry into and participation in the Fresh Choice Nature’s Fresh Back to School Be in to Win
(Promotion) is deemed acceptance of these Terms and Conditions which includes any information on how to enter and prizes.

Who can enter?

Entry is open to residents of New Zealand, subject to these Terms and Conditions (Eligible Entrant). You are not eligible to enter if you are an employee or contractor of the participating store or the Promoter, or a member of an employee’s immediate family.
Under 18? If you are under 18 years old at the time of entering, you must obtain the prior permission and consent of your legal parent or guardian. Any prize will be awarded to the successful entrant’s nominated parent or guardian.

Multiple Entries

You may enter the Promotion multiple times, provided you follow the ‘How to enter?’ rules for each separate entry. You are not permitted to use any automated entry software or any other mechanical or electronic means that allows you to automatically enter or enter repeatedly. Any such entries will render all entries submitted by that person invalid. You are responsible for any associated costs of entry, including internet access and phone calls.

Promotion Period

The Promotion commences at 12.01AM NZT on 20 th January 2025 and will close at 11.59PM NZT on 16th February 2025.

How to enter?
To enter the Promotion and be eligible to win, you must, during the Promotion Period:
a) Purchase any Nature’s Fresh product from any Super Value or Fresh Choice store;
b) Entry form will be printed at the bottom of your receipt; and
c) Complete the Promotion entry form by inputting all of the requested details (including your
first name, last name, email address, contact number and receipt number) and submit the
fully completed entry form into the entry box.

Receipts

If you tear the entry form off the receipt, you must retain your receipt. Failure to produce the proof of purchase by including the receipt number on the entry form or otherwise when requested by the Promoter may, in the absolute discretion of the Promoter, result in invalidation of the Eligible Entry and forfeiture of any prize. Purchase receipts must clearly specify the store of purchase and that the purchase was made during the Promotion Period but prior to entering.

Prize(s)
Each prize comprises a Sonic Character Plushie, Sonic Zak Slimline lunch bag and a Sonic Zak ice pack, which are together valued at $120 (including tax). There will be 1 prize per Participating Store, 75 prizes in total. Prize(s) are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

Prize draw
There will be a separate prize draw for each Participating Stores. Each prize draw will be held on or before 21 February 2025 at the relevant Participating Store. The winner(s) will be the first valid entry randomly drawn from all Eligible Entries received at the relevant Participating Store, ie 1 winner per Participating Store. The Promoter reserves the right to draw additional reserve entries to be deemed as alternate winners in the event of a prize forfeiture.

Notification to winner(s)
Winner(s) will be notified by the participating store by Friday 21 February 2025 by email/phone using the email address/phone number provided by the Eligible Entrant.

Accepting the prize
Following the notification to winner(s), winner(s) will need to collect the prize from the participating store. If a winner does not collect the prize within 5 days of being notified, the prize will be forfeited.
The Promoter reserves the right to award any forfeited prize to another eligible entrant from reserve entries drawn. If a winner of a prize is under the age of 18 years, the prize will be awarded to their parent or guardian.

Your entry

You promise and warrant that all the details submitted with your entry are true and correct.

Receipt of entries
Neither the Promoter nor any other entity associated with this promotion will be responsible for any late, lost, misdirected, corrupted, incomplete or incorrectly submitted entries. Entries are deemed to be submitted at the time of receipt by the Promoter or its agents.
No endorsement
You acknowledge and agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with any software, application or website used to enter the Promotion including Facebook and Instagram. If you use any software, application or website to enter the Promotion, that use is subject to any applicable terms of use. In the event of any inconsistency between such terms and these Terms and Conditions, these Terms and Conditions will prevail.

Promoter’s rights:
The Promoter reserves the right to: provide an alternative prize of equal monetary value in the event that a prize or any part of a prize becomes unavailable for any reason beyond the Promoter's control; disallow entries in its absolute discretion; verify the validity of entries and determine the eligibility of entrants (including an entrant's identity) and to disqualify any entry or refuse to award a prize where dishonest or misleading details have been given by an entrant, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions or the spirit of the Promotion; to terminate this Promotion or amend any aspect of this Promotion (including the prize) without notice at any time in its sole discretion in the event that this Promotion or any aspect of this Promotion cannot be reasonably conducted as planned; and enforce any of its rights at any stage and failure to do so does not constitute a waiver of those rights.

Exclusion
The Promoter shall not be liable for any loss or damage whatsoever which is or may be suffered (including but not limited to indirect or consequential loss) or for personal injury which is or may be suffered or sustained, in connection with participation in the Promotion or accepting any prize, except
for any liability which cannot be excluded by law.

Indemnity
As a condition of participating in the Promotion, the winner and their parent/guardian (if applicable) indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with that promotion against all claims, damages, liabilities, costs and expenses (including legal fees on a solicitor and client basis) which the Promoter may incur arising out of the winner’s participation in the Promotion and/or participation in a prize, howsoever caused.

Publicity
By entering the draw or accepting a prize you and your parent/guardian (where applicable) consent to the use of your name, likeness, image or voice in any media for an unlimited period of time without remuneration for the purposes of the Promotion and promoting any products manufactured, supplied or distributed by the Promoter.

Privacy
The information collected about entrants in the course of the Promotion has been requested to enable the Promoter to conduct the Promotion in accordance with these Terms and Conditions (including publicity), and for promotional purposes. Promoter
The promoter is Goodman Fielder New Zealand Limited of 2/8 Nelson Street, Auckland 1010. All decisions of the Promoter are final and no correspondence will be entered into.
